Standard Terms & Conditions

1. Introduction

Our Terms and condition sets in place all matters relating to the contracts between the school and the parents. The terms and conditions are intended to be enforceable by the parties stated above. The terms and conditions elicit the custom and practice of independent co-educational institutions for many years and together with the letter of offer, fees list, school rules and regulation form the basis of a legally binding contract between the parents and the school for the provision of educational services. The basic rules and regulations and other issues set out are provided in good faith. They are set to create and provide operational stability, effective planning that are geared towards proper resourcing and development of Best Brain College

1.1 Prospectus and Website

The college prospectus and website explain the general principles and practices in which the school operates and expressly indicate the school's history and ethos. However, the details articulated in the prospectus and contained on the website are just PART of the agreement between you and us. Parents are advised to seek clarifications on any matter captured in the prospectus or on the website before entering this Agreement.

1.2 Duration of Agreement

The agreement is for the duration of your child/wards stay with us at the school. The offer of admission and its subsequent acceptance are provided on the ground of the information provided at the point of admission and if the school finds a contrary information, the head reserves the right to cancel or terminate such admission without refund(s). Parents will be given adequate notice in the event of any changes that would have a material effect on your child/wards educational or pastoral care. The school reserves the right to review the fees level each year and there will be reasonable changes from time to time. If the ownership and /or legal status of the school changes, the school's rights and obligation under these standard terms and conditions will be clearly assigned to the new entity.

2. Definition

"The school" / "We"/ "Us" refers to Best Brain College by its governing body as now or in the future as constituted. "The Head" is the person (Director) who is responsible for the day-to-day running of the school and that expression also includes the principal and those who are saddled with any duties of the Head or of the Governing Body that have been responsibly delegated. "The parents"/"You" refers to any person who has signed the Acceptance form and / or who has accepted responsibility for a child's attendance at this school. Therefore, parents are individually and jointly legally responsible for complying with their obligations under these Terms and Conditions. Parents are expected to give their maximum support and encouragement to the actualization of the school's aims and to uphold and promote its good reputation; to continue their ward's education at home and to ensure that their ward maintains appropriate standards of punctuality, behavior, diligence, language, discipline and dressing.

2.1 Parental Responsibility

Those who have "parental responsibility" (i.e legal responsibility for the child) are entitled to receive reliant information concerning the child whether or not they are party to this contract unless a court order has been made to the contrary, or there are other reasons which justifies withholding information to safeguard the interests and welfare of the child.

2.2 The pupil/Ward

"The pupil"/ "Ward" is the child on our admission list.

2.3 Guardian

"Guardian" means a legal guardian who is saddled with responsibility of fulfilling parental role and carries out parental responsibility in the absence of the parent. "Term and Conditions" means guiding rules and regulations as amended from time to time.

2.4 Application fees

"Application fees" means the non-refundable administration fee payable when collecting application form.

2.5 Application Form

"Application Form" means the form completed by you, together with a non-refundable application fee, to register your wish that your child/wards want to attend the school

2.6 Entry

"Entry" means the date on which your child/ward attends the school for the first time

2.7 under the terms of this Agreement.

"Fees"/fee means the fees as set out I the schedule of fees as amended from time to time.

3. Admission and Entry to the school

3.1 Registration and Admission

Registration and Admission: Applicants will be considered as candidate for admission into the College when the application form has been completed and returned to us and applicable non-refundable application fee paid.

3.2 Offer of a place, acceptance and deposit

Offer of a place, acceptance and deposit: Admission will be subject to the availability of a place and students satisfying the admission requisites of the time. Admission is deemed to have been completed when parents accept the offer of a place/admission, by completing, signing and returning the Acceptance form and paying the non-refundable fees as stated on the schedule of fees.

3.3 Equal Treatment

Equal Treatment: The school is a day and boarding school for boys and girls aged from 10 � 17years. The school is founded on sound morals and virtue but welcome staff and children from diverse ethnic groups, back grounds and creed. Fundamental human rights and freedoms are acknowledged and respected.

4. PASTORAL CARE

4.1 Meaning

Meaning: Pastoral care is a virtue that runs throughout all aspects of life and what we do in the school and it is directed towards the success, safety, happiness, right counsel and welfare of each student and the integrity of the school community at large.

4.2 Our commitment

Our commitment: We give all it takes to safeguard and promote your child's care and to provide pastoral care beyond the standard required by law in all circumstances. We acknowledge and respect your child's human rights and freedoms which must be within the ambit of the law and rules of our school community and the rights and freedoms of others.

4.3 Complaints

Complaints: Any question, complaints, concern of any kind must be channeled to the management as soon as practicable.

4.4 Ethos

Ethos: The ethos of this school is to foster good relationship between members of staff and the students. Bullying, harassment, victimization and discrimination are not tolerated. The school and its staff will act fairly in relation to matters involving students and parents and we expect same from students and parents in relation to the school.

4.5 Physical Contact

Physical Contact: Parents give their consent to such physical contacts as may be accorded with good practice and be appropriate and proper for teaching and instruction and for providing comfort to a student in distress or to maintain safety and good order, or in connection with the contact sports and other activities as part of the normal school and co-curricular activities and acknowledge that while the school will provide appropriate supervision, the risk or injury cannot be eliminated.

4.6 Disclosures

Disclosures: Parents must, as a matter of duty, disclose to the school in confidence any known medical condition, health problem or allergies affecting the student under our care, any history of a learning challenge/difficulty in the part of the student or any member of his/her immediate family; or any disability/special educational need or any behavioral, emotional, family circumstances or court order which might affect the student's welfare, or happiness, or any concerns about the student's safety.

4.7 Complaints and Bullying

Complaints and Bullying: if you have cause for concern to a matter of safety, care, discipline or progress of your child/ward, you must inform the school immediately for instant action. The school cannot be held responsible for failing to address a situation that the school is not privy to.

4.8 Confidentiality

Confidentiality: In some cases, teachers and other employees of the school may need to be informed of any particular vulnerability a student may have. The school reserves the right to monitor the students for the purpose of ensuring compliance with the school rules.

4.9 Special precautions

Special precautions: The Head needs to be aware of any matters that are relevant to the student's safety and security. The Head must therefore be notified in writing immediately of any court orders or situations of risk in relation to the pupil for whom any special safety precautions may be needed. Parents may be excluded from the school premises, if the Head acting in a proper manner and in good faith considers such exclusion to school in the best interests of the student and the school.

4.10 Leaving school premises

Leaving school premises: We will do all that is necessary to ensure that your child remains in the care of the school throughout the duration of a term (boarders) and within the operating daily hours for day students or extended period but we cannot accept responsibility for the pupil if they leave school premises (breech of school rules).

4.11 Absence

Absence: The school must be well informed in writing of any reasons for any absence from school by your child/ward. The school expects your child/ward 100% attendance during the full term's duration. However, in the event of any exceptional circumstances, prior permission of the Head is required.

4.12 Education Guardians

Education Guardians: A pupil of any age whose parents are resident outside the Federal Republic of Nigeria must have an education guardian in Nigeria who can and has been given authority to act on behalf of the parents in all respects and to whom the school can apply for authorities when necessary. The school cannot accept responsibility during half term or during term holidays for pupils whose parents are resident abroad or outside Oyo State. The parents and guardians in this category must make holiday arrangements, including travel to and from the school well in advance. The responsibility for choosing an appropriate education guardian rest solely with the parents.

4.13 School publications

School publications: From time to time the school will issue press releases and publications which include newsletters, marketing materials and web sites updates. Such publications may include images of pupils. Consent for a pupil's image and name to be used by the school will be deemed to have been given unless parents write to the Head stating that they do not wish the image of their child to appear in any school publication.

4.14 Transport

Transport: Our tested and trusted drivers take our students in and out of town with the prior consent of their parents at their payment for such service (payment here signify consent).

4.15 Pupil's personal property

Pupil's personal property: Students are responsible for the security and safe use of all their personal properties and parents are responsible for ensuring that all such property is clearly marked for proper identification. Only items in the to-bring-list authorized by the school are allowed to brought to school (For hostel students).

4.16 Liability

Liability: Unless negligent or guilty of some other wrong doing causing injury, loss or damage, the school does not accept responsibility for accidental injury or other loss caused to the pupil or parents or for loss or damage to property.

5. HEALTH AND MEDICAL MATTERS

5.1 HEALTH AND MEDICAL MATTERS

The Head should be informed in witting if the pupil has or develops any known medical condition, health problem or will be unable to take part in games or sporting events, or has been in contact with infectious diseases.

5.2 Pupil's Health

Pupil's Health: The Head may at any time require medical opinion or certificate confirming the pupil's general health and well being where the Head deems it necessary as a matter of professional judgement in the interest of the child and / or the school. If the pupil concerned in of sufficient age and maturity, he/she is entitled to insist on confidentiality which can nonetheless be overridden in the pupil's own interest or where necessary in the interest and protection of other members of the school community.

5.3 EMERGENCY MEDICAL TREATMENT

In the event of a medical emergency, where parents cannot be reached instantly, the school reserves the right to take a very sick student to the nearest and relatively good medical facility for medical attention pending when the parents can be reached. It is presumed that the parents are in charge once they have been reached. Kindly note that all expenses accruing for such will be wholly borne by the parents. The school only runs a SICK BAY for first aid treatments only.

6. EDUCATIONAL MATTERS

6.1 Our commitment

Our commitment: We will do all that is reasonable to provide a conducive educational environment and teaching of a range, standard and quality which is suitable for each pupil to excel in their chosen area of interest.

6.2 Organization

Organization: We reserves the right to organize the curriculum and its delivery in a way which, in the professional judgment of the Head, is most appropriate to the school community as a whole. Any parent who has specific requirements or serious concerns about any aspect of their child's education or progress should contact the principal.

6.3 Progress Reports and Reference

Progress Reports and Reference: The school monitors the progress of each pupil and reports from time to time to parents by means of grades, full written reports and feedbacks. Where parents are separated or divorced, reports and other information will be sent to the person with whom the pupil normally resides.

6.4 Pupil's progression

Pupil's progression: You child/ward is expected to progress through the school and ultimately complete the sixth form. The school is not obliged to promote your child/ward to the next class unless we are satisfied that it is appropriate to do so, with regards to his/her academic attainments, conduct and relevant circumstances.

6.5 Public Examination

Public Examination: The school will enter a pupil's name for an examination if the principal is satisfied that such is in the best interests of the pupil. In the exercise of professional judgment, the head may decline to do so, if it is considered that by doing so, the pupil's success in that examination is not guaranteed.

6.6 School's Intellectual Property

School's Intellectual Property: The school reserves all rights and interest in any copyright, design work, patent or trademark arising from the actions or work of the pupil in conjunction with any member of staff and/or other pupils at the school for a purpose associated with the school.

6.7 Pupil's original work

Pupil's original work: Copyright in the pupil's original work, such as classroom work, press or homework, projects, internal examination scripts, belongs to the pupil. Most of such work will be returned to the pupil when it is no longer required for assessment.

6.8 Educational Visit

Educational Visit: Educational visits will be provided for our students. Educational visits oversea will be subject to distinct agreement with parents. The costs associated with such trips will be borne by the parents. The pupil is subject to the school policy on discipline in all aspects while participating in such school trip.

7. Behaviour and Discipline

7.1 Conduct and Attendance

Conduct and Attendance: Parents warrant that the pupil should conduct themselves in accordance with the set rules and regulation as well as the school's set policy standards. The parents warrant that pupil will actively participate in the activities of the school, will be punctual, will work hard, will be decently behaved and abide by the rules covering the wearing of uniform and general appearance. We attach importance to courtesy, integrity, good manners, and respect for others.

7.2 School Regime

School Regime: The parents accept that the school will be run in accordance with the authorities delegated by the government. The Director is entitled to exercise a wide discretion in relation to the school's policies, rules and regime and will exercise those discretions in a reasonable and lawful manner.

8. FEES AND EXTRAS

7.1 Comment

Comment: Kindly note that fees uploaded here pertains only to 2025/2026 academic session. However, management reserves the right to adjust fees upwards with regards to current inflationary trends. Therefore, it is advised that prospective parents contact our bursary department to confirm the validity of these figures to guide their decisions.
